Terms & Conditions of Sale

1. General Information

Kel Trade Limited t/as Builderstuff supplies equipment and supplies to commercial customers. All sales are contractually treated as business-to-business (B2B). Private customers (consumers) who order goods via the website should be aware of our B2B terms.

f you are making a purchase for yourself, the transaction will not be covered by the consumer Distance Selling Regulations (DSR) and by continuing you unequivocally agree to the fact that the transaction is being made by a purchaser for or on behalf of a business.

 

In this Agreement:

  • "Customer" means any person or business who places an Order with Kel Trade Limited t/as Builderstuff.
  • "Goods" means any items sold or supplied by Kel Trade Limited t/as Builderstuff under an Order.
  • "Builderstuff" is a trading name of Kel Trade Limited, a company incorporated in England (Company No. 09909229) with a registered address at:

  • "Order" means an order placed via the website, phone, or email to purchase Goods.
  • Orders are subject to acceptance by Kel Trade Limited t/as Builderstuff. The company is not obliged to accept any Order or justify refusal. Receipt of payment does not constitute order acceptance.

2. Goods Being Sold

All product images are for illustrative purposes and though we always aim to ensure accuracy, the design and colour may differ from the final delivered product. Special offers are subject to stock availability and may change without prior notice.

Orders for Goods in a specific colour, pattern, or design are subject to stock availability. We reserve the right to substitute items with newer versions or products of comparable or superior quality with customer approval.

Customers ordering age-restricted goods (e.g., solvents, knives) must confirm they are 18 years of age or older, and delivery must be accepted by someone over 18.


3. Pricing & Payment

  • All prices are exclusive of VAT unless stated otherwise. VAT-inclusive prices are displayed for information only.
  • Prices are subject to change without notice, but the price applicable is the one valid at the time of order placement.
  • Errors in pricing or product descriptions: If a pricing or description error occurs, we are under no obligation to honour the incorrect price. We will contact the Customer and, if necessary, issue a refund.
  • Payment methods: Orders can be paid using major debit/credit cards (some may incur an administration fee). Goods will not be dispatched until full payment is received.
  • If an item is out of stock, we will notify the Customer and offer a refund, backorder, or suitable substitute.
  • Refunds are typically processed the same day, but bank processing may take up to 3 working days.

4. Delivery

  • Delivery charges and options are published on our website and may change periodically.
  • Next Working Day Delivery is available for UK Mainland orders placed before 2 PM. Orders after this time are not guaranteed for next-day delivery.
  • Working Days: Monday to Friday, excluding public holidays.
  • Special delivery services (e.g., Saturday deliveries) are available upon request.
  • Offshore and remote area deliveries will be dispatched promptly but are subject to varying delivery times.
  • We aim to meet delivery estimates but are not liable for delays beyond our control.
  • Missed/Cancelled Deliveries:
    • A storage charge of 2% of invoice value per month applies until successful delivery.
    • Any refused/declined deliveries (including third-party supplier deliveries) will result in applicable fees being charged to the Customer.
  • Goods are used, stored, and installed at the Customer's risk. We are not responsible for any damage, loss, or disruption caused by the same.

5. Warranties & Returns

5.1 Warranty Period

  • Goods are warranted for 12 months from the date of delivery, provided they are:
    • Used as intended and not misapplied.
    • Free from material defects in design, material, and workmanship.
    • Fit for the purposes stated in our literature.

5.2 Warranty Claims

  • If a defect is discovered, the Customer must:
    • Notify us in writing within a reasonable time at info@builderstuff.co.uk.
    • Allow us a reasonable opportunity to examine the Goods.
    • Return defective Goods to us at our expense if requested.
  • If a warranty claim is valid, we will replace or refund the defective Goods.
  • Claims must include returned samples, original packaging, and box label references.

5.3 Warranty Exclusions

The warranty does not cover defects arising from:

  • Continued use after notifying us of an issue.
  • Improper storage, installation, or maintenance.
  • Fair wear and tear, negligence, misuse, incorrect application, or abnormal storage conditions.
  • Unauthorised alterations or repairs.
  • Changes to Goods made for compliance with legal or regulatory requirements.

5.4 Return Handling Charges

  • Returns may be subject to a handling charge, as detailed in our returns policy.

6. Order Cancellation & Termination

  • We may cancel or suspend any Order where payment has failed or credit checks indicate an issue.
  • We reserve the right to suspend or terminate agreements in case of:
    • Force majeure (e.g., extreme weather, government restrictions).
    • Suspected unlawful purchases (e.g., restricted solvents).

7. Liability

  • We are not liable for:
    • Losses or damage suffered by the Customer, including business interruption or loss of profit.
    • Additional damages caused by failure to report faults promptly.
  • This Agreement does not exclude liability for injury or death where legally required.

8. Intellectual Property & Confidentiality

  • Goods may be subject to copyright or licensing agreements.
  • Customers must not infringe any intellectual property rights associated with the Goods.
  • Any breach of intellectual property rights may result in legal action and the requirement to indemnify us against losses.
  • Customer data protection rights are detailed in our privacy policy on the website.

9. General Terms

  • Any delay or failure to enforce this Agreement does not constitute a waiver of rights.
  • If any clause is deemed invalid, illegal, or unenforceable, the remaining terms remain in effect.
  • This Agreement does not confer rights on third parties (Contracts (Rights of Third Parties) Act 1999).
  • We may subcontract or assign obligations under this Agreement.
  • This Agreement is governed by English law, and disputes will be subject to English courts.
